HB  00Update on sessionThe regular run of the 2008 Legislative Session ended on March 1 with Veto Day scheduled for March 17. Major bills that passed were 3% increase for state aid for education, 3% increase for state employees, and 3% increase for providers. The Highway Patrol money was NOT reinstated. Liquor license laws were significantly changed. Tech Institutes were given $3 million dollars plus put in place a new funding formula. Property tax ag assessment changes were made with a years delayed implementation and the 150% rule repealed. It was a very busy and hectic session. Motorcycles faired very well.
HB  1031Dept. bills on workers comp- 1031-1037I have listed these bills in case you are interested in them.Check the website as HB 1032 and HB 1034 were killed in committee.All of these bills have been killed in committee.One bill was revived and is still alive in a conference committee.
HB  1144Money for new motorcycles in Safety CourseThis bill provides for $150,000 from the motorcyle license fee fund for Dept. of Public Safety to buy new or used bikes for the Motorcycle Safety Course. ABATE is working on this bill with Chief Sponsor Rep. Mike Buckingham. Bill passed House Transportation Committee 14-0 and the House Appropriations Committee unamimously. Bill passed the House 69-0. Bill passed the Senate Appropriations Committee 9-0 and passed Senate 33-0. Governor signed.
HB  1153Bill to allow parents to teach kids drivers ed and sets up requirements for certificationThis bill provides requirements and procedures for parent taught drivers' education courses and to allow parents to teach driver education to their qualified children. Bill was killed in committee.
HB  1191Displaying customized motorcycles at certain eventsSets up procedures to display customized motorcycles at certain events without a temporary license. This bill puts dealers from out of state on an even playing field with instate dealers as far as licenses.Passed the House 67-0.Bill passed the Senate 34-0. Governor signed
HB  1195Damage Disclosure Changes for vehiclesThis bill attempts to raise the damage disclosure required on vehicles from $5000 to $7500. This bill was killed in committee.
HB  1197Seat belt changesThis bill requires all passengers to use seat belts and violation remains a secondary offense.Bill died on the House floor 31-37.
HB  1198Revises the fine for petty offenseBill changes the amount of fine for petty offense to $25.00.Passed House Judiciary and the House.Bill passed Senate 32-1. Governor signed.
HB  1203Bill dealing with liquor consumptionIf you are interested there are a number of bills dealing with changing liquor license laws, number of licenses, wine and beer licenses. Check the LRC website.There are liquor law changes in bills on the House Floor. One bill - SB 126- passed the Senate giving cities local control over licenses. This bill passed House Commerce on Friday with an amendment to include restaurants with sales of 50% liquor and no smoking. Will be on House floor on Tuesday. Another liquor bill HB 1294 - bill to give additional liquor licenses to restaurants in first class municipalities was hoghoused with SB 126 in House State Affairs. House passed and Senate voted not to concur and appoint conference committee.The conference committee cut a deal on allowing new liquor licenses for restaurants that only have 40% liquor sales, no smoking. Bill then passed House and Senate concurred with amendment. The liquor laws were significantly changed this session with the passage of HB 1142 - HyVee bill and SB 126. In addition the Piedmont bill passed to allow them to charge $30,000 for the liquor license.
HB  1208Reemburse motorists for hitting wildlifeThis bill would require Game,Fish and Parks to reemburse motorists for hitting a deer if you can determine the deer was at fault. I don't know how you would do this. Bill was killed in committee.
HB  1235Reduce license fees for purple heart recipientsThis bill reduces license fees for purple heart recipients. Bill was killed in Trans Committee and some of the contents of this bill were put into SB 156.
HB  1237Local control of tobacco productsThis bill would allow local units of govt to regulate the sales, distribution, marketing, promotion and use of tobacco products.Bill was killed in committee.Bill was smoked but out and hoghoused to be a state wide smoking ban but a violation of the legislative rules occurred so bill just disappeared from the calendar. This was a first.
HB  1255Titling and regulating low speed vehiclesThis bill defines low speed vehicles and then set procedures for titling and and licenses.Bill passed Transportation Committee. Bill passed the House 63-6 after further defining a low speed vehicle. Bill passed Senate 30-5 with minor amendment. House concurred with amendment. On Governor's desk.
HB  1261Guns on college campusesBill states that no college may prohibit the carrying of guns in accordance with state law.Bill passed the House State Affairs Committee and the House - 63-3. Bill was killed in Sen. State Affairs Committee, smoked to the floor and again failed.
HB  1275Easement at Bear ButteThis is a Governor's Bill to appropriate state money to be combined with federal money for the purchase of an easement around Bear Butte.Bill was killed on the House floor after an amendment to prohibit liquor within a mile.
HB  1282Bill dealing with off road vehicles and riskThis bill deals with assumed risk for operators of off road vehicles and changes where they can operate.Bill passed Transportation Committee 10-2, passed the House 53-15. Bill was killed in Senate Trans Committee.
HB  1309Prohibit liquor license near Bear Buttethis bill would prohibit liquor license within one mile of Bear Butte.Bill was killed in committee.
HB  1315Creates Highway Finance Task ForceBill creates a 14 member Highway Finance Task Force to study overall funding and availability of funding sources.Killed on the House floor as some members felt this is the responsibility of the Transportation Commission.
SB  103Establish provisions regarding the use of replacement crash parts Bill attempts to set up provisions regarding the use of replacement crash parts in the repair of certain motor vehicles. Bill passed the Senate. Requires dealers to use manufacturer's parts for one year to replace parts in new cars.Bill was tabled in House Commerce.
SB  13Minors Driving PrivilegesAllows for the suspension of a minor's driving privileges if they violate a county or municipal ordinance. Passed Senate 33-2.Passed House with an amendment and Senate concurred with the amendment. Governor signed.
SB  147Seat belt lawRevises seat belt law to be a primary offense. Bill was killed in committee.
SB  15Provide for an electronic vehicle titleDept. of Revenue bill to provide for an electronic certificate title.Passed the Senate 34-0.Passed the House with an amendment and Senate concurred with the amendment. Governor signed.
SB  156Special Motor Vehicle License PlatesThis bill would provide special vehicle including motorcycle plates for veterans with a disability, prisoners of war, Pearl Harbor survivors and Purple Heart recipients.A person is limited to two plates. ABATE supports this bill.Passed the Senate 33-0.Bill was amended with some of the language from HB 1235 and passed committee. Bill passed House with minor amendment 70-0 and Senate concurred with the amendment. On Gov's desk.
SB  172Appropriates money to Highway PatrolThis bill would appropriate money to the Highway Patrol budget which the Governor has recommended cutting $2 million due to budget shortfalls.Bill was amended in Senate Appropriations to $1.4 million and sent to the Senate floor.Bill was amended back to $2 million and passed Senate. Bill is now in House Appropriations Committee. Bill was put in a conference committee and they could not reach resolution so bill was killed.
SB  185Restrictions for license platesThis bill will restrict what combinations of letters and numbers can be on license plates. Letters or numbers cannot be profane, derogatory,etc.Bill was tabled in committee.
SB  20Repeal personalized motor vehicle platesThis bill was killed in Committee so you will be able to have personalized plates.
SB  35Establishing fair claims standard and procedures for property casualty insurance claims.Am researching this bill currently and will be talking to the insurance industry people as to the specific changes.Dept. of Revenue bill.Bill was amended and passed the Senate - 26-9.Bill was killed in House Commerce.
SB  68Repeals certain provisions regarding mufflers on bikesSen. Napoli is the chief sponsor of this bill to repeal the law on mufflers on motorcycles. This law is a clean-up as mufflers on motorcycles are covered under another statute concerning motor vehicles. Law enforcement is using the statute and penalties under the motor vehicle statutes. Passed Senate Transportation Committee 7-0. Passed the Senate.Passed the House 65-5. On Governor's desk.
